Can You Get Maternity Leave on an Apprenticeship

Eligibility for Maternity Leave

As an apprentice, your eligibility for maternity leave depends on various factors. To be entitled to maternity leave, you must meet the following criteria:

  1. Apprenticeship Status: You need to be classified as an employee under an apprenticeship agreement, which means you work for an employer while undergoing on-the-job training.
  2. Employment Period: To qualify for maternity leave, you must have been employed by your current employer for at least 26 weeks by the 15th week before your expected week of childbirth (known as the “qualifying week”).

Types of Maternity Leave

Once you meet the eligibility requirements, there are two types of maternity leave you can take:

  1. Ordinary Maternity Leave (OML): OML is available for all employees, including apprentices, regardless of their employment duration. OML lasts 26 weeks, giving you the right to return to your apprenticeship after the leave period.
  2. Additional Maternity Leave (AML): Following OML, you can take up to 26 additional weeks, making the total maternity leave period 52 weeks. AML is also available to all employees, including apprentices.

Maternity Pay

Maternity pay refers to the financial support you receive during your maternity leave. As an apprentice, your entitlement to maternity pay depends on various factors, including your length of service and employment status. Here’s a breakdown of the options:

  1. Statutory Maternity Pay (SMP): If your employer employs you and has continuously worked for at least 26 weeks by the qualifying week, you may be eligible for SMP. SMP is paid for up to 39 weeks, and during the first six weeks, it is paid at 90% of your average weekly earnings. The remaining 33 weeks are paid flatly (or 90% of your average weekly earnings, whichever is lower).
  2. Maternity Allowance: If you do not meet the criteria for SMP, you may still be eligible for Maternity Allowance from the government. Maternity Allowance is a weekly payment for up to 39 weeks based on your average weekly earnings.

Returning to Your Apprenticeship

After your maternity leave, you can return to your apprenticeship under the same terms and conditions as before your absence. This includes any pay increases or benefits that occurred during your absence.

Notifying Your Employer

To ensure a smooth transition, it is essential to inform your employer about your pregnancy and your intention to take maternity leave. The notice period is at least 15 weeks before the expected week of childbirth. This enables your employer to plan for your absence and ensure necessary arrangements are made.
