Maternity Pay during Apprenticeships

As an apprentice, you are generally considered an employee; therefore, you have certain rights and benefits, including maternity pay. The amount and duration of maternity pay you receive depend on your circumstances, such as the length of your employment and your employer’s policy.

Statutory Maternity Pay (SMP)

If you are eligible, you may be entitled to Statutory Maternity Pay (SMP) during your apprenticeship. To qualify for SMP, you must meet the following criteria: 

  1. Have worked for your employer continuously for at least 26 weeks before the 15th week before the baby is due (known as the qualifying week). 
  2. Earn an average of at least £120 per week.

SMP Amount and Duration

The standard rate for SMP is usually 90% of your average weekly earnings for the first six weeks. After that, you’ll receive £151.20 per week or 90% of your average weekly earnings (whichever is lower) for the next 33 weeks. Your employer can provide the necessary information if you’re unsure about your earnings.

Additional Employer Benefits

Some employers offer enhanced maternity pay beyond SMP. This could mean receiving a higher percentage of your earnings during your maternity leave or extending the duration of the enhanced pay period. Check your apprenticeship contract or speak with your employer’s HR department to understand what additional benefits they may provide.

Notification of Pregnancy

It’s crucial to inform your employer of your pregnancy immediately. You should provide written notice stating your due date and the date you plan to start your maternity leave. Your employer may request a MATB1 form from your midwife or GP, which confirms your pregnancy and due date. You should notify your employer at least 15 weeks before your baby is due.

Maternity Leave Entitlement

As an apprentice, you are entitled to the same maternity leave as any other employee. This means you can take up to 52 weeks of maternity leave, regardless of your length of service.

Maternity Rights during Maternity Leave

While on maternity leave, your employment rights are still protected. Your contract terms, including your apprenticeship agreement, remain valid during this period. You can return to the same job or position with the same terms and conditions once your maternity leave ends.

Redundancy Protections

Apprentices on maternity leave have special redundancy protections. If your employer decides to make redundancies during your maternity leave, they must offer you a suitable alternative position (if available) before considering other employees for the role.
